{"id":653,"date":"2023-12-20T17:17:54","date_gmt":"2023-12-20T17:17:54","guid":{"rendered":"https:\/\/education.jhu.edu\/edpolicy\/?post_type=us_state&#038;p=653"},"modified":"2026-01-06T20:08:55","modified_gmt":"2026-01-06T20:08:55","slug":"oregon","status":"publish","type":"us_state","link":"https:\/\/education.jhu.edu\/edpolicy\/policy-research-initiatives\/homeschool-hub\/states\/oregon\/","title":{"rendered":"Oregon"},"content":{"rendered":"<h2>History<\/h2>\n<p>Oregon, located in the western United States, legalized homeschooling in <a href=\"https:\/\/www.oregonlegislature.gov\/bills_laws\/ors\/ors339.html\" target=\"_blank\" rel=\"noopener\">1985<\/a>.<\/p>\n<h2>Regulation<\/h2>\n<p id=\"E162\" class=\"x-scope qowt-word-para-9 x-scope qowt-word-para-9 x-scope qowt-word-para-9\"><a id=\"E163\" href=\"https:\/\/www.oregon.gov\/ode\/learning-options\/HomeSchool\/Pages\/infoforfamilies.aspx\" target=\"_blank\" rel=\"noopener\"><span id=\"E164\">Oregon<\/span><\/a><span id=\"E165\"> offers one option for homeschooling. Parents who want to homeschool their children, ages 6 to 18, must notify the local education service district electronically or by mail. The notification should include the student&#8217;s name, address, date of birth, and prior or current school or district. Annual notification is not required. See <\/span><span id=\"E166\" class=\"qowt-font5-Tahoma\">Or. <\/span><a id=\"E167\" href=\"https:\/\/www.oregonlegislature.gov\/bills_laws\/ors\/ors339.html\" target=\"_blank\" rel=\"noopener\"><span id=\"E168\" class=\"qowt-font5-Tahoma\">Rev. Stat<\/span><\/a><a id=\"E169\" href=\"https:\/\/www.oregonlegislature.gov\/bills_laws\/ors\/ors339.html\" target=\"_blank\" rel=\"noopener\"><span id=\"E170\" class=\"qowt-font5-Tahoma\">. \u00a7339.035 <\/span><\/a><span id=\"E171\" class=\"qowt-font5-Tahoma\">(2) and <\/span><span id=\"E172\" class=\"qowt-font5-Tahoma\">Or. Admin. Rules<\/span><span id=\"E173\" class=\"qowt-font5-Tahoma\"> \u00a7<\/span><a id=\"E174\" href=\"https:\/\/secure.sos.state.or.us\/oard\/displayDivisionRules.action?selectedDivision=2562\" target=\"_blank\" rel=\"noopener\"><span id=\"E175\" class=\"qowt-font5-Tahoma\">581-021-0026 (1)(f), (4).<\/span><\/a><span id=\"E176\" class=\"qowt-font5-Tahoma\">\u202f\u00a0<\/span><span id=\"E177\"><\/span><\/p>\n<p id=\"E180\" class=\"x-scope qowt-word-para-9\"><span id=\"E181\">Oregon provides a <\/span><span id=\"E182\">standards<\/span><span id=\"E183\"> guide, but parents do not have to adhere to the state\u2019s suggestions and can select their own curriculum and instructional materials. The state does not have required subjects, record keeping, minimum instruction hours, or minimum parental education requirements. <\/span><\/p>\n<p id=\"E186\" class=\"x-scope qowt-word-para-9\"><span id=\"E187\">New homeschool families have an 18-month \u201cgrace period\u201d and do not require testing or assessments. However, after 18 months, homeschooled students must test in certain grades or every year if they participate in interscholastic activities. Parents may choose from a list of approved tests. It does not appear that funding is available for the required testing or that homeschool families can take the state assessment free of charge. If a child scores below the 15<\/span><span id=\"E188\">th<\/span><span id=\"E189\"> percentile, the child must be retested within the year. If low performance occurs for three consecutive years, the superintendent could require the child to receive instruction from a certified teacher or <\/span><span id=\"E190\">attend<\/span><span id=\"E191\"> a traditional school. See <\/span><span id=\"E192\">Or. Rev. Stat<\/span><span id=\"E193\">. \u00a7339.035(4) and <\/span><span id=\"E194\">Or. Admin. Rules<\/span><span id=\"E195\"> \u00a7581-021-0026(7)(a), (b), and (d) for details.<\/span><span id=\"E196\"><\/span><\/p>\n<p id=\"E199\" class=\"x-scope qowt-word-para-10\"><span id=\"E200\" class=\"qowt-font1-Calibri\">Oregon views homeschools as existing outside the public system. Therefore, homeschooled students do not have access to public resources. How<\/span><span id=\"E201\">ever, h<\/span><span id=\"E202\" class=\"qowt-font1-Calibri\">omeschooled students do have <\/span><a id=\"E203\" href=\"https:\/\/www.oregonlegislature.gov\/bills_laws\/ors\/ors339.html\" target=\"_blank\" rel=\"noopener\"><span id=\"E204\" class=\"qowt-font1-Calibri\">access<\/span><\/a><span id=\"E205\" class=\"qowt-font1-Calibri\"> to interscholastic opportunities at their local public school. These opportunities are unfunded and not offered to other nonpublic students. Further, students may need<\/span><span id=\"E206\"> to<\/span><span id=\"E207\" class=\"qowt-font1-Calibri\"> show academic progress and test annually <\/span><span id=\"E208\">to<\/span><span id=\"E209\" class=\"qowt-font1-Calibri\"> participate. See <\/span><span id=\"E210\" class=\"qowt-font1-Calibri\">Or. Rev. Stat<\/span><span id=\"E211\" class=\"qowt-font1-Calibri\">. \u00a7339.460 and <\/span><span id=\"E212\" class=\"qowt-font1-Calibri\">Or. Admin. Rules<\/span><span id=\"E213\" class=\"qowt-font1-Calibri\"> \u00a7581-021-0333.<\/span><span id=\"E214\" class=\"qowt-font1-Calibri\">\u202f<\/span><span id=\"E215\" class=\"qowt-font1-Calibri\">The<\/span><span id=\"E216\" class=\"qowt-font1-Calibri\"> state <\/span><span id=\"E217\">acknowledges <\/span><span id=\"E218\" class=\"qowt-font1-Calibri\">an obligation to identify all children with special needs within its <\/span><span id=\"E219\">boundaries<\/span><span id=\"E220\" class=\"qowt-font1-Calibri\">. <\/span><span id=\"E221\">Deciding whether or not to provide special needs occurs <\/span><span id=\"E222\" class=\"qowt-font1-Calibri\">at the district level.<\/span><\/p>\n<h2>State Data<\/h2>\n<p>Oregon collects and reports homeschool participation information. The state only requires a family report when they begin homeschooling and does not need to provide an annual update. The limited participation data makes it difficult to understand homeschooling participation trends and how many students homeschool in Oregon.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-1855\" src=\"https:\/\/education.jhu.edu\/edpolicy\/wp-content\/uploads\/sites\/8\/2025\/12\/OR.png\" alt=\"\" width=\"1468\" height=\"1050\" srcset=\"https:\/\/education.jhu.edu\/edpolicy\/wp-content\/uploads\/sites\/8\/2025\/12\/OR.png 1468w, https:\/\/education.jhu.edu\/edpolicy\/wp-content\/uploads\/sites\/8\/2025\/12\/OR-300x215.png 300w, https:\/\/education.jhu.edu\/edpolicy\/wp-content\/uploads\/sites\/8\/2025\/12\/OR-1024x732.png 1024w, https:\/\/education.jhu.edu\/edpolicy\/wp-content\/uploads\/sites\/8\/2025\/12\/OR-768x549.png 768w\" sizes=\"auto, (max-width: 1468px) 100vw, 1468px\" \/><\/p>\n<p><span id=\"E277\"><span id=\"E244\"><a href=\"https:\/\/www.census.gov\/library\/stories\/2021\/03\/homeschooling-on-the-rise-during-covid-19-pandemic.html\" target=\"_blank\" rel=\"noopener\">U.S. Census estimates<\/a><\/span> indicate that around 8.3% of Oregon families homeschooled in the spring of 2020. That percentage increased to 13.0% by the fall of 2020. This was higher than the national average of 11.1% at this time. Based on <a href=\"https:\/\/www.census.gov\/programs-surveys\/household-pulse-survey\/data.html\" target=\"_blank\" rel=\"noopener\">U.S. Census data<\/a><span data-contrast=\"auto\" xml:lang=\"EN-US\" lang=\"EN-US\" class=\"TextRun SCXW261661158 BCX0\"><span class=\"NormalTextRun SCXW261661158 BCX0\">, our calculations indicate that about 6.53<\/span><span class=\"NormalTextRun SCXW261661158 BCX0\">% of K-12 students in Oregon<\/span><span class=\"NormalTextRun SCXW261661158 BCX0\"> were homeschooled during the 2022-23 school year, and 7.03<\/span><span class=\"NormalTextRun SCXW261661158 BCX0\">% during the 2023-24 school year. <span class=\"NormalTextRun SCXW186328771 BCX0\">Due to<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\"> <\/span><span class=\"NormalTextRun SCXW186328771 BCX0\">survey<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\"> changes<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\">, the<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\"> data from 2020<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\"> reflects<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\"> the percentage of households, while <\/span><span class=\"NormalTextRun SCXW186328771 BCX0\">the data from <\/span><span class=\"NormalTextRun SCXW186328771 BCX0\">following years<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\"> reflect<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\">s the percentage of<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\"> students<\/span><span class=\"NormalTextRun SCXW186328771 BCX0\">.<\/span><\/span><\/span><\/span><\/p>\n<a class=\"wysiwyg_button\" href=\"https:\/\/docs.google.com\/spreadsheets\/d\/1xFaTmfL1W-rkgrT_M39aApH2SVTjpnte\/edit?usp=sharing&amp;ouid=112367036183430899073&amp;rtpof=true&amp;sd=true\" target=\"_self\"><span class=\"wysiwyg_button_label\">Download Homeschool Hub State Data<\/span><\/a>\n<h2>Cross-Sector Comparison<\/h2>\n<p>We cannot calculate a cross-sector comparison because we lack information on total homeschool participation.<\/p>\n<h2>School Choice Context<\/h2>\n<p><span id=\"E304\" style=\"font-size: 1.125rem\">In addition to homeschooling, parents in Oregon have various <\/span><a id=\"E305\" style=\"background-color: #ffffff;font-size: 1.125rem\" href=\"https:\/\/www.edchoice.org\/school-choice\/state\/oregon\/\" target=\"_blank\" rel=\"noopener\"><span id=\"E306\">educational choices<\/span><\/a><span id=\"E307\" style=\"font-size: 1.125rem\"> available. <\/span><span style=\"font-size: 1.125rem\">These options include enrollment in traditional public schools, including inter- and intra-district choice, magnet, and charter schools. Oregon has no private school choice programs or public funding for homeschooling.<\/span><\/p>\n<h2>Commentary<\/h2>\n<p>Oregon could increase access for all nonpublic students to offerings at public schools, including extracurriculars and courses. They could also report more data they collect, such as student age, grade, and district.
